FCC sets aside Supreme Court ruling concerning Monal Restaurant operations
The Federal Communications Commission (FCC) set aside the Supreme Court's judgment concerning the Monal Restaurant's operations. The FCC also set aside the Supreme Court's conclusion regarding the running of restaurants. The FCC accepted review petitions submitted by the Capital Development Authority (CDA) and the Municipal Corporation Islamabad (MCI). Furthermore, the FCC ordered an independent decision on all pending Industrial Court Appeals (ICAs).
The Supreme Court bench had previously ordered the relocation of the Monal Restaurant and other establishments. The SC judgment, which spanned forty-four pages, stated that the construction and running of restaurants impaired the object of the national park and lacked any connection to public education or research. Regarding legal provisions, the FCC noted the reenactment of a provision similar to Section 21 of the Ordinance of 1979. The FCC's actions indicate a review of the initial judicial findings concerning commercial activities within the park area.
The SC judgment’s paragraph stated, “the construction and running of restaurants impaired the object of the national park and the same also had no nexus with public education and/ or research. Therefore, the restaurants could not be allowed to operate.”
