Chief Justice of the Islamabad High Court Sardar Muhammad Sarfraz Dogar ordered the formation of a new bench to adjudicate a constitutional petition on 30 October.
The legal challenge seeks to overturn a ruling issued by the Judicial Commission of Pakistan on 28 April. Yawar Gardezi stated that the petition was submitted under Article 199 of the Constitution, identifying the Federation of Pakistan, the Judicial Commission, the President, and the Prime Minister as the respondents.
Sardar Muhammad Sarfraz Dogar acknowledged his previous role as a member of the Judicial Commission involved in the contested decision.
"I do not want to pass any order in this case, as it may give the impression that favour is being extended," Sardar Muhammad Sarfraz Dogar said. The Chief Justice adjourned the proceedings and instructed that the matter be presented to a different bench within one or two days.
The new bench is also required to review the objections raised in the petition.
