The Islamabad High Court barred officials from assigning a government residence in Sector G-6 to any other person or transferring its possession until further orders on 29 October.
Justice Muhammad Azam Khan delivered the ruling during a hearing of a petition submitted by Adnan Majeed Khan, a Grade-20 deputy registrar of the Islamabad High Court. Khan's legal challenge contested the decision to keep a specific government unit held for a particular officer until it becomes vacant.
The petitioner alleged that the authorities acted beyond their legal mandate by approving such a reservation.
He argued that the practice of holding accommodation for a specific person under a "pending until availability" status is unlawful. Khan maintained that the Government Servants (Conduct and other applicable accommodation) rules dictate that residential units must be distributed according to seniority on the general waiting list for the relevant category.
He further asserted that the current allotment regulations do not allow for the advance reservation of government housing for any single individual. Legal counsel for the petitioner noted that an allottee must take possession of a house within 10 days of the official allotment.
The counsel also stated that any modification to accommodation is subject to specific conditions and requires approval from the relevant ministry. The court directed the respondents to provide para-wise comments and replies before the next scheduled hearing. The next court proceedings are set for 30 October.
