In a significant legal development, the Lahore High Court has ruled that arrests made on the basis of supplementary statements recorded after an FIR are illegal. The ruling was delivered by Justice Muhammad Tariq Nadeem during a bail application hearing for accused Umar Farooq in a murder case.

The court’s written verdict explicitly states that an arrest based on mere suspicion, verbal information, or delayed supplementary statements lacks legal standing. This decision underscores the importance of adhering to established legal procedures and fundamental rights as enshrined in the Constitution of Pakistan.

Justice Nadeem further ruled that a confession before police carries no legal value if it is not part of an initial FIR. The court’s directive aims at ensuring that all future arrests are based on concrete evidence rather than speculative or delayed information, thereby reducing the risk of wrongful detentions and enhancing judicial integrity.

In response to the ruling, Additional IG Investigation Shahzad Sultan admitted that no legal provision exists for supplementary statements. He acknowledged that investigation officers often misuse such statements for malicious purposes. In a bid to comply with the court’s directive, Sultan assured the court that no accused would henceforth face arrest solely on the grounds of supplementary statements.

The Lahore High Court has directed the Inspector General of Punjab Police to circulate copies of the verdict to all Regional Police Officers, City Police Officers, and District Police Officers across the province. This move is aimed at ensuring uniform implementation of the court’s ruling and preventing any future misuse of supplementary statements in legal proceedings.

Justice Nadeem also ordered a strict legal review of all arrests made based on supplementary statements and sought an implementation report within two weeks. The court granted post-arrest bail to Umar Farooq, alias Ehtesham, in the murder case as part of its ruling.

The decision is expected to have far-reaching implications for law enforcement practices across Punjab and beyond. By declaring such arrests illegal, the Lahore High Court has set a precedent that could influence future legal interpretations and practices regarding supplementary statements.
