Screenwriter sues Alexander Payne over alleged script theft for The Holdovers

A screenwriter has filed a lawsuit against director Alexander Payne, alleging that the script for the film The Holdovers was based on an unproduced screenplay set in a children’s hospital. The legal action names David Hemingson as a defendant in the case.
The plaintiff contends that the plots of the two scripts share 46 matched incidents. The original script, titled Frisco, follows a discouraged doctor who cares for a precocious teenage patient at a hospital.
In Frisco, the characters form a friendship during a journey to San Francisco before the doctor chooses to resign and begin a cross-country trek. The lawsuit alleges that elements from Frisco were incorporated into drafts of The Holdovers through Payne's input to Hemingson.
Drawing on his own experiences as a pediatrician, the writer produced Frisco, which eventually ranked third on the Black List.
