The Khyber-Pakhtunkhwa Advocate General’s Office requested the governor and other relevant authorities, including the provincial assembly speaker, to provide responses to writ petitions contesting the imposition of emergency and governor’s rule in parts of the province.

Pakistan Tehreek-e-Insaf (PTI) Chairman Barrister Gohar Ali Khan and other individuals submitted these petitions to the Peshawar High Court. Barrister Gohar Ali Khan and his co-petitioners alleged that the emergency in specific districts and the subsequent governor’s rule in others are illegal and unconstitutional.

The petitioners contended that the provincial government maintained control over the situation in Khyber-Pakhtunkhwa, making such extreme measures unnecessary. The petitioners also claimed that the provincial government holds the domain over deploying troops to assist the civil administration. The high court scheduled a further hearing for the petitions on 10 November 2026.

A bench led by Justice Sahibzada Asadullah and Justice Inamullah reviewed writ petitions regarding the detention of 23 people, including Akbar Sher, Shehzad, Razaullah, Saqib, Ehsanullah and Momin Khan. The high court provided interim relief to 23 additional PTI workers who were detained under Section 3 of the Maintenance of Public Order (MPO) Ordinance, directing their release on bail.

Each petitioner was ordered by the court to be released against two surety bonds valued at Rs100,000. The court adjourned the hearing until 12 November 2026.
