Ivan Toney pleaded not guilty to the charge of assault causing actual bodily harm. The incident in question took place on 6 December last year. Following the altercation, Da Silva sustained injuries to his nose and fingers. The District Judge, Briony Clarke, questioned Toney regarding his preference for the hearing venue, asking if he wished the case heard at magistrates or crown court. Toney subsequently confirmed his desire for the case to proceed at the crown court.

The court confirmed that Toney's trial will take place before a judge and jury. After a Metropolitan police investigation, Toney faced charges on 31 July. Furthermore, Toney was released on unconditional bail. A spokesperson for Toney stated that Ivan acknowledges the charge and looks forward to being given the opportunity to clear his name in court. Professionally, Toney has secured 10 caps for England. He currently plays for the Saudi Pro League side Al-Ahli. Toney moved to Al-Ahli in 2024 for £40m.
